Ši Naudotojo licencijos sutartis ("Sutartis") yra teisinis susitarimas tarp jūsų (fizinio asmens ar vieno subjekto) ir VB Coding ("Licenciato") dėl programos Aplink Mane ("Programinė įranga") naudojimo.
Įdiegdami, kopijuodami ar kitaip naudodami Programinę įrangą, sutinkate laikytis šios Sutarties sąlygų. Jei nesutinkate su šiomis sąlygomis, nesidiekite ir nenaudokite Programinės įrangos.
Pagal šios Sutarties sąlygas, Licenciatas suteikia jums ribotą, neišimtinę, neperleidžiamą licenciją naudoti Programinę įrangą viename mobiliame įrenginyje, kurį jūs valdote.
Jūs negalite:
Programinė įranga yra saugoma autorių teisių ir tarptautinių autorių teisių sutarčių, taip pat kitų intelektinės nuosavybės įstatymų ir sutarčių. Programinė įranga yra licencijuota, o ne parduodama. Licenciatas išlaiko visas teises, nuosavybės teises ir interesus Programinėje įrangoje, įskaitant visus autorių teises, patentus, komercines paslaptis, prekių ženklus ir kitus intelektinės nuosavybės teises.
Ši Sutartis galioja, kol bus nutraukta. Jūsų teisės pagal šią Sutartį bus automatiškai nutrauktos be įspėjimo, jei nesilaikysite bet kurios šios Sutarties sąlygos. Nutraukus šią Sutartį, privalote nutraukti Programinės įrangos naudojimą ir sunaikinti visas jos kopijas.
PROGRAMINĖ ĮRANGA TEIKIAMA "TOKIA, KOKIA YRA", BE JOKIŲ TIESIOGINIŲ AR NETIESIOGINIŲ GARANTIJŲ, ĮSKAITANT, BET NEAPSIRIBOJANT, PREKINIŲ SAVYBIŲ, TINKAMUMO TAM TIKRAM TIKSLUI AR TEISIŲ NEPAŽEIDIMO GARANTIJOMIS. LICENCIATAS NĖRA ATSAKINGAS UŽ BET KOKIUS NUOSTOLIUS AR ŽALĄ, ATSIRANDANČIUS DĖL PROGRAMINĖS ĮRANGOS NAUDOJIMO.
MAKSIMALIAI LEIDŽIAMA TAIKYTI PAGAL GALIOJANČIUS ĮSTATYMUS, LICENCIATAS NEBUS ATSAKINGAS UŽ JOKIUS SPECIALIUS, NETIESIOGINIUS, INCIDENTINIUS ARBA KITUS NETIESIOGINIUS NUOSTOLIUS, ATSIRANDANČIUS DĖL PROGRAMINĖS ĮRANGOS NAUDOJIMO AR NEGALIMYBĖS JĄ NAUDOTI, NET JEI LICENCIATAS BUVO INFORMUOTAS APIE TOKIŲ NUOSTOLIŲ GALIMYBĘ.
Jūs sutinkate, kad Licenciatas gali rinkti ir naudoti techninius duomenis ir susijusią informaciją, įskaitant informaciją apie jūsų įrenginį, operacinę sistemą ir programinės įrangos versiją, siekiant teikti programinės įrangos atnaujinimus ir kitą techninę pagalbą.
Programinė įranga naudoja jūsų vietos duomenis, kad parodytų jums artimiausius lankytinus objektus. Šie duomenys nėra saugomi. Galite išjungti šią funkciją, išjungdami vietos nustatymo paslaugas savo įrenginio nustatymuose.
Ši Sutartis bus taikoma ir aiškinama pagal Lietuvos Respublikos teisės aktus, neatsižvelgiant į teisės kolizijos nuostatas.
Ši Sutartis yra visas susitarimas tarp jūsų ir Licenciato dėl Programinės įrangos naudojimo ir pakeičia visas ankstesnes rašytines ar žodines sutartis dėl šios sutarties objekto.
11.1. Naujų vietų pridėjimas galimas tik prisijungus su Google Sign In sistema.
11.2. Pridėdamas naują vietą ar nuotrauką vartotojas perleidžia nuotraukos teises Aplink Mane kūrėjams, suteikdamas neatlygintinai jas naudoti ir platinti programėlėje.
11.3. Vartotojas įkeldamas nuotrauką užtikrina, kad nuotraukos autorinės teisės priklauso jam.
11.4. Vartotojas pagal savo pastangas nurodo kiek įmanoma tikslesnę informaciją apie lokaciją, jeigu ji paimta iš atvirų šaltinių - nuorodą į šaltinį.
11.5. Vartotojas įkeldamas naują vietą sutinka matyti šalia jos savo vardą bei nuotrauką
12.1. Vietų redagavimas galimas tik prisijungus su Google Sign In sistema.
12.2. Vartotojas redaguodamas vietą privalo pateikti kuo tikslesnę jam žinomą informaciją ir vengti ją iškraipyti.
12.3. Redaguodamas vietą ir pridėdamas nuotrauką vartotojas perleidžia nuotraukos teises Aplink Mane kūrėjams, suteikdamas neatlygintinai jas naudoti ir platinti programėlėje.
12.4. Vartotojas redaguodamas vietą sutinka matyti šalia jos savo vardą bei nuotrauką
13.1. Vartotojas pasižada sąžiningai dalyvauti žymėjimosi varžybose ir leidžia programėlei rodyti jo vardą, pavardę, bei nuotrauką statistikoje.
13.2. Pasižymėjimų istorija saugoma neribotą laiką, nebent vartotojas paprašo ją ištrinti.
Prisijungdamas prie aplikacijos, vartotojas sutinka, kad jo nuotrauka, vardas ir pavardė bus rodomi aplikacijoje. Programėlė nenaudoja jokios šios informacijos kitais tikslais.
15.1. Vartotojo prieiga prie programėlės gali būti užblokuota už bet kokius aukščiau nurodytus pažeidimus.
15.2. Norėdami nutraukti paskyrą, susisiekite el. paštu aplinkmane@gmail.com.
16.1. Visos naujai pridėtos vietos ir nuotraukos yra peržiūrimos administratorių.
16.2. Administratoriai pasilieka teisę atmesti arba pašalinti bet kokį turinį, kuris neatitinka programėlės standartų arba pažeidžia šios sutarties sąlygas.
16.3. Sprendimas dėl turinio patvirtinimo ar atmetimo priimamas per 7 darbo dienas.
17.1. Programėlė naudoja Google Sign In autentifikavimo sistemą.
17.2. Prisijungiant per Google Sign In, programėlė gauna prieigą prie jūsų vardo, pavardės, el. pašto adreso ir profilio nuotraukos.
17.3. Šie duomenys naudojami tik vartotojo identifikavimui ir rodymui programėlėje.
18.1. Visi ginčai, kylantys iš šios sutarties ar susiję su ja, sprendžiami derybų keliu.
18.2. Nepavykus išspręsti ginčo derybomis, ginčas sprendžiamas Lietuvos Respublikos teismuose.
18.3. Kolektyviniai ieškiniai nėra leidžiami.
19.1. Įkeldamas nuotrauką, vartotojas suteikia Aplink Mane programėlei neatšaukiamą, neribotą laike, nemokamą licenciją:
19.2. Vartotojas išlaiko autorines teises į nuotrauką.
Vartotojas įsipareigoja atlyginti ir apsaugoti Aplink Mane programėlę nuo bet kokių pretenzijų, nuostolių ar išlaidų (įskaitant teisines išlaidas), kylančių dėl vartotojo veiksmų, sutarties pažeidimų ar neteisėto programėlės naudojimo.
21.1. Aplink Mane negarantuoja nepertraukiamo programėlės veikimo.
21.2. Techninė priežiūra gali būti atliekama bet kuriuo metu, iš anksto neįspėjus.
21.3. Programėlės funkcionalumas gali būti laikinai apribotas dėl techninių ar kitų priežasčių.

Mes vertiname jūsų pasitikėjimą pateikiant mums savo asmeninę informaciją, todėl stengiamės taikyti komerciškai pagrįstas priemones jai apsaugoti. Tačiau nė vienas perdavimo internetu ar elektroninės saugyklos būdas nėra 100% saugus, todėl negalime garantuoti absoliučios jūsų duomenų apsaugos.

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and VB Coding ("Licensor") for the use of the Aplink Mane software application ("Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
Subject to the terms and conditions of this Agreement, Licensor hereby grants you a limited, non-exclusive, non-transferable license to use the Software on a single mobile device owned or controlled by you.
You may not:
The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including all copyrights, patents, trade secret rights, trademarks, and other intellectual property rights therein.
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term(s) of this Agreement. Upon termination of this Agreement, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree that Licensor may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Software. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you. For more information, please refer to our Privacy Policy.
The Software uses location data sent from your mobile device to display your position and show attractions around you. We do not store or retain this location data. You can disable this functionality at any time by turning off location services for the App in your device settings.
This Agreement will be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.
This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter.
11.1. Adding new places is only possible when logged in with Google Sign In.
11.2. By adding a new place or photo, the user transfers the rights to the photo to Aplink Mane creators, granting them permission to use and distribute it in the app free of charge.
11.3. When uploading a photo, the user confirms that they own the copyright to the photo.
11.4. The user provides as accurate information as possible about the location and, if taken from open sources, includes a reference to the source.
11.5. By adding a new place, the user agrees to have their name and photo displayed alongside it.
12.1. Editing places is only possible when logged in with Google Sign In.
12.2. When editing a place, the user must provide the most accurate information known to them and avoid distorting it.
12.3. When editing a place and adding a photo, the user transfers the rights to the photo to Aplink Mane creators, granting them permission to use and distribute it in the app free of charge.
12.4. By editing a place, the user agrees to have their name and photo displayed alongside it.
13.1. The user commits to honestly participate in check-in competitions and allows the app to display their name and photo in statistics.
13.2. Check-in history is stored indefinitely unless the user requests its deletion.
By logging into the application, the user agrees that their photo, first and last name will be displayed in the application. The app does not use this information for any other purposes.
15.1. User access to the application may be blocked for any violations of the above terms.
15.2. To terminate your account, please contact aplinkmane@gmail.com.
16.1. All newly added places and photos are subject to administrator review.
16.2. Administrators reserve the right to reject or remove any content that does not meet app standards or violates this agreement.
16.3. Decisions regarding content approval or rejection will be made within 7 business days.
17.1. The app uses Google Sign In for authentication.
17.2. When signing in through Google Sign In, the app receives access to your name, email address, and profile photo.
17.3. This information is used solely for user identification and display within the app.
18.1. All disputes arising from or relating to this agreement shall be resolved through negotiation.
18.2. If a dispute cannot be resolved through negotiation, it shall be resolved in the courts of the Republic of Lithuania.
18.3. Class action lawsuits are not permitted.
19.1. By uploading a photo, the user grants Aplink Mane app an irrevocable, perpetual, royalty-free license to:
19.2. The user retains copyright ownership of the photo.
The user agrees to indemnify and hold harmless Aplink Mane app from any claims, losses, or expenses (including legal fees) arising from the user's actions, violations of this agreement, or illegal use of the app.
21.1. Aplink Mane does not guarantee uninterrupted service.
21.2. Maintenance may be performed at any time without prior notice.
21.3. App functionality may be temporarily limited due to technical or other reasons.
By using the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
